SCOTUS: The Day After

I
am guessing that this is a more-than-typically pleasant morning for John Paul Stevens.

Is this Stevens' best-case scenario? Gets Bush to pick a successor (I've heard he still has some party loyalty), but a Democratic Senate ensures it's a moderate.

The Senate has veto power over any nominee. Therefore, if it wishes, it could ensure
that Stevens' successor is a liberal. For that matter, it could choose a particular individual by telling Bush that it would veto anyone else. Bush's only way around it would be to refuse to nominate anyone, in which case the Democrat elected in 2008 would do so. Sorry, I'm just fantasizing a bit. But, seriously, Bush is a war criminal and, if the Democrats will not impeach and prosecute him, they at least do not owe him the deference that the Senate usually accords to presidents.
