Never heard of the Volokh Conspiracy, but after reading that thread, I am left wondering why you would bother with them (or indeed why they all bother with one another).

Hang on - they demand that the records and minutes of a private organization so they can interrogate a man about his beliefs and doings three decades before,

and you don't see the parallel to McCarthy?

Well, as a conservative with web access and therefore a member of the Digital Brownshirt Brigade, and as a guy who voted for a fellow that sooooo many on the left compare to Hitler, I don't find the analogy as strained as some other analogies that pass more or less without comment.

Hang on - they haul a man up in front of the US Senate, question him for days on end under the glare of tv cameras, demanding a detailed public accounting of his political beliefs and activities, and threaten to deny him employment if he doesn't answer to their satisfaction,

and you don't see the parallel to McCarthy?

Clearly, Senate confirmation hearings are themselves the embodiment of McCarthyism.
